Terms of Service

Last updated: 10 September 2026

These Terms are the contract between you and us. They cover your account, your content, Tokens and gifts, and what each of us is responsible for. What you may and may not post is set out in the Community Guidelines, which form part of these Terms.

1. About these Terms

These Terms are a contract between you and Nathans Mad Pty Ltd, ABN 44 664 001 012 ("Nathans Mad", "we", "us", "our"). They cover the FcPal app on iOS and Android, our websites at fcpal.com and app.fcpal.com, and anything else we provide as part of FcPal (together, the "Service").

FcPal is currently available in Australia only.

Three documents, three jobs.

These Terms are the contract. They set out what you and we each agree to.

The Community Guidelines set out what you may and may not post and do on FcPal. They form part of these Terms and are as binding as anything in this document.

The Privacy Policy explains how we handle your personal information. It is not a contract and you are not asked to agree to it. It is there so you know what we do.

Where these Terms and the Community Guidelines cover the same ground, these Terms prevail.

Agreeing to these Terms. You agree to these Terms when you create an account. We keep a record of the version you accepted and when.

If you do not agree to these Terms, do not create an account.

2. Who can use FcPal

You must be 18 or over, and you must be able to enter into a binding contract.

You may not use FcPal if we have previously closed your account for breaching these Terms or the Community Guidelines, or if using FcPal would breach a law that applies to you. You may not create a new account to get around a closure or restriction.

You must not use FcPal if you are located in a country subject to sanctions or embargoes that would make providing the Service to you unlawful, or if you are on a list of prohibited or restricted parties.

3. Your account

Accurate information. Give us accurate information when you sign up and keep it up to date.

One person, one account. Your account is personal to you. Do not share it, sell it, buy one, or transfer it. Do not create an account for someone else, and do not hold more than one account without our permission.

Security. Keep your password private. Turn on two-factor authentication in Settings if you can. Tell us at safety@fcpal.com straight away if you think someone else has access to your account.

You are responsible for activity that happens under your account, except to the extent that the activity was not caused or contributed to by your failure to take reasonable care with your account, your password or your devices, or where it happens after you have told us your account may be compromised.

Your devices. Your private messages are protected by encryption keys that are held on your devices and not by us. If you lose access to all of your devices you may lose access to your message history, and we will not be able to recover it. How this works is set out in section 12 of the Privacy Policy.

4. How you may use FcPal

We give you a personal, limited, non-exclusive, non-transferable and revocable right to use FcPal for your own personal, non-commercial use, in line with these Terms and with the rules of the app store you installed the app from.

You must not:

5. Content standards

What you may and may not post, send, broadcast or say on FcPal is set out in the Community Guidelines. They apply to everything you do on FcPal, including in private messages and calls.

If you breach the Community Guidelines we may remove your content, end a live broadcast, limit what you can do, or suspend or close your account. The Community Guidelines explain how those decisions are made, what happens for different kinds of breach, and how to ask us to review a decision.

6. Your content

You own what you create. You keep any rights you have in the photos, videos, Pick a Line posts, live broadcasts, messages, comments and other material you put on FcPal ("your content").

The licence you give us. So that FcPal can work, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, transcode, resize, cache, transmit, display and distribute your content and to create thumbnails and previews of it, for the purpose of operating, protecting and improving the Service and showing your content to the people you have chosen to share it with.

This licence includes the right to sublicense these rights to our service providers, acting on our instructions and only for those same purposes. The Privacy Policy explains who those providers are and what they do.

The licence lasts while your content is on FcPal and for the short period after deletion described in section 11 of the Privacy Policy. It ends when you delete the content or your account, except where someone else has already re-shared it within FcPal in a way you allowed, or where we are required to keep a copy for legal or safety reasons.

Moral rights. To the extent permitted by law, you consent to us and our service providers doing anything that would otherwise infringe your moral rights in your content, for the purposes set out above. This includes reformatting, resizing, cropping, transcoding, and creating thumbnails and previews, and using your content without attribution where the format does not allow for it.

Your responsibility. You are responsible for your content. You confirm that you have the rights and consents you need to share it, including from anyone who appears in it or can be identified from it.

What we do not do with your content. Section 3.5 of the Privacy Policy sets out what we do not do with your content and with information about you. Those statements are commitments we make to you and we treat a breach of them as a breach of these Terms.

Feedback. If you send us ideas or suggestions about FcPal, we may use them without any obligation to you. You give us a licence to use them for any purpose and, to the extent permitted by law, consent to us doing anything that would otherwise infringe your moral rights in them.

If you believe content on FcPal infringes your copyright or another intellectual property right you own, email copyright@fcpal.com.

What your notice needs to contain.

If your notice does not contain these things we may not be able to act on it and we will tell you what is missing.

What we do. We aim to acknowledge notices within 2 business days and to act on complete notices promptly. If we remove content, we will tell the person who posted it, tell them why, and give them a copy of the notice.

Disputing a removal. If your content was removed and you believe the removal was wrong, email copyright@fcpal.com with:

We will send your dispute to the person who made the original complaint. If they do not tell us within 10 business days that they are taking legal action, we may restore the content.

Repeat infringers. We close the accounts of people who repeatedly infringe other people's intellectual property rights.

Misuse. Do not send a notice or a dispute that you know to be false. Doing so is a breach of these Terms and may make you liable to the other person.

8. Live broadcasts

When you broadcast on FcPal you are responsible for everything that appears and is said in your broadcast, including anything done or said by other people who appear in it. You must have the consent of everyone who appears in your broadcast, including anyone who is in the room with you.

Live broadcasts are subject to the Community Guidelines. We may end a broadcast at any time if it breaches them.

Recordings of your broadcasts are stored so you can share them as posts. You choose whether a recording is shared. A shared recording is treated as a post.

9. Messages, calls and FC Mode

Sections 4 and 12 of the Privacy Policy explain how end-to-end encryption and FC Mode work, and what information stays on your device. This section sets out what you and we are agreeing about them.

We cannot see your private messages and calls. Because of this, we cannot moderate them, we cannot recover them, and we cannot produce their contents to you or to anyone else. If you want us to act on something in a conversation, you have to report it, which sends us a copy from your own device.

Encryption does not protect you from the other person. The person you are talking to can save, copy, screenshot or photograph anything you send them. Sharing a private conversation without the consent of everyone in it breaches the Community Guidelines, but we cannot prevent it happening.

FC Mode is a convenience, not a guarantee. It can be defeated, it may not detect every onlooker, and it does not stop the other participant from capturing the conversation. Do not rely on it to keep anything secret that would harm you if it were seen.

Calls depend on your device and your network connection. We do not guarantee that a call will connect or stay connected.

Blocking and reporting. The Community Guidelines explain how to block someone and how to report a conversation to us.

10. Tokens, Gems and gifts

FcPal has virtual items that let people support each other. Tokens are spent on gifts. Gifts are sent to another person on a broadcast, a post or a Pick a Line post. Gems are what a person receives when they are sent a gift.

Tokens and Gems are not money. They are a limited right to use features of the Service. They have no cash value, are not your property, cannot be transferred between accounts outside the app, and cannot be sold or exchanged with anyone other than us. Your balance is a record in our systems, not funds we hold for you.

Getting Tokens. We may give you Tokens free of charge, for example as a welcome bonus. We may also sell Tokens through the Apple App Store or Google Play. Where we do, the purchase is made with and processed by Apple or Google under their terms, and the price shown at the time of purchase is the price you pay. Tokens are not currently sold in the app.

Expiry. Tokens you have purchased do not expire. Tokens we have given you free of charge may expire or be withdrawn, and we will tell you before that happens where it is practical to do so.

Who processes payment. Apple and Google process all payments for Tokens. We never receive your card details.

Refunds. Tokens are used up when you spend them and gifts are delivered immediately, so purchases of Tokens are not refundable, except where the law requires otherwise, including under the Australian Consumer Law, or where Apple or Google grant a refund under their own policies.

Because Apple and Google process the payment, a refund request goes to them first, under their policies. We cannot process a refund for a purchase made through an app store. If a purchase is refunded after the Tokens have been spent, we may deduct the equivalent Tokens or Gems from your account.

Unauthorised purchases. If someone used your account to buy Tokens without your permission, contact the app store you bought through, and tell us at support@fcpal.com.

Gifts are voluntary. Sending a gift is a personal decision to support someone. It does not buy any service, content, attention or response from them, and it cannot be reversed once sent. Using gifts to solicit sexual content, or to pressure or coerce anyone, is a serious breach of the Community Guidelines.

Gems. Gems record the gifts you have received. Gems can be exchanged for Tokens inside the app at the rate shown at the time of the exchange. Gems cannot be withdrawn as money and there are no creator payouts. If we introduce payouts, they will be governed by separate creator terms that you will need to accept first.

Changes. We may change the price of Tokens, the gifts available, the Gem to Token exchange rate, and what Tokens can be used for. Where a change is significant we will give you reasonable notice, and for a change to the exchange rate you will have a reasonable period to exchange at the old rate before the new one applies.

Corrections. We may correct your balance where it is wrong because of a technical error, fraud, a chargeback, or a breach of these Terms. We will tell you when we do and why.

If your account closes. If we close your account for breaching these Terms or the Community Guidelines, your Tokens and Gems are forfeited. If you close your own account, we will refund any Tokens you purchased and have not spent. Gems are not refundable in either case.

11. Verification badge

Some verification badges are granted on merit after review. Others are a paid feature.

A paid badge renews every 30 days by deducting Tokens from your account at the price shown when you applied. If your balance is not enough at renewal, the badge stays active for a short grace period while we retry, then is suspended until you top up. You can cancel at any time in Settings. The badge stays active until the end of the period you have paid for, and Tokens are not refunded for the remainder of that period.

What a badge means. A badge shows that an account has a badge. It is not a verification of anyone's identity, and a paid badge in particular says nothing about who the account holder is. Do not rely on a badge to decide whether someone is who they say they are.

We may suspend or remove a badge if your account breaches these Terms or the Community Guidelines, or if the information you gave us when you applied was inaccurate.

12. Our intellectual property

FcPal, the FcPal name and logo, the app, the websites, and their design and code are owned by us or our licensors and are protected by intellectual property laws. Nothing in these Terms transfers any of those rights to you. Your right to use the app is the licence described in section 4, and it ends when your account is closed.

13. App stores and third parties

Apple. If you use FcPal on an Apple device, the following also applies. These Terms are between you and us only, and not with Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide any maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the app to you, if any. To the maximum extent permitted by law Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility. We, and not Apple, are responsible for addressing any claims by you or a third party relating to the app or your use of it, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation. We, and not Apple, are responsible for investigating, defending, settling and discharging any third-party claim that the app infringes intellectual property rights. You must comply with applicable third-party terms when using the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Google. If you use FcPal on Android, your use of Google Play is subject to the Google Play Terms of Service. Google is not responsible for the app or for these Terms, and refunds for anything purchased through Google Play are handled by Google under its policies.

Signing in with Google or Apple is subject to their terms.

Links to other websites are provided for convenience. We are not responsible for them.

Section 9 and section 10 of the Privacy Policy explain the service providers we use and where your information is processed.

14. Suspension, termination and closing your account

Closing your own account. You can delete your account at any time in Settings. Section 11 of the Privacy Policy explains what happens to your information and how long the process takes.

Suspension and closure by us. We may limit what you can do, suspend your account, or close it if:

Where a breach is not serious, we will normally warn you before we act. Where the risk to other people is serious, we may act without notice. The Community Guidelines set out how these decisions are made and how to ask for a review.

Stopping the Service. We may stop providing all or part of the Service. If we do, we will give reasonable notice where we can, and we will refund any Tokens you purchased and have not spent.

What happens on closure. Your right to use the app ends, your content is removed from FcPal as described in the Privacy Policy, and Tokens and Gems are dealt with as described in section 10.

What survives. Sections 6, 7, 10, 12, 15, 16, 17 and 19 continue to apply after your account is closed, along with any other section that by its nature should.

15. Consumer guarantees, warranties and liability

Your rights under the Australian Consumer Law are not affected. Our services come with guarantees that cannot be excluded under the Australian Consumer Law, including that they will be provided with due care and skill and be reasonably fit for purpose. Nothing in these Terms excludes, restricts or modifies those guarantees, or any other right you have under a law that cannot be excluded.

Otherwise, the Service is provided as it is. Subject to the paragraph above, we provide FcPal on an "as is" and "as available" basis. We do not promise that it will be uninterrupted, error-free or secure, or that content on it is accurate or appropriate.

We are not responsible for the conduct of other users, online or offline, and you interact with them at your own risk. We are not responsible for loss caused by you losing access to your devices or your encryption keys, or by another person recording, screenshotting or sharing something you sent them.

FC Mode. FC Mode reduces a risk. It does not remove it. Subject to the consumer guarantees above, we are not liable for loss arising from FC Mode failing to detect an onlooker.

Pre-release. FcPal is currently a pre-release product. Features may change, be withdrawn, or not work as intended, and there may be more faults than in a finished product.

Limit on our liability. To the extent permitted by law, and subject to the consumer guarantees above, our total liability to you for all claims arising out of or relating to these Terms or the Service is limited to the greater of the amount you paid us in the 12 months before the claim and AUD 100. We are not liable for indirect or consequential loss, or for loss of profits, data, goodwill or opportunity. Where a consumer guarantee applies and the law allows us to limit our liability, our liability is limited, at our option, to supplying the service again or paying the cost of having it supplied again.

What this limit does not cover. Nothing in this section limits our liability for fraud, for wilful misconduct, for death or personal injury caused by our negligence, for a breach of the Privacy Act 1988, or for anything else that cannot be limited or excluded by law.

16. Your responsibility to us

To the extent permitted by law, you agree to compensate us for any loss, liability, claim or cost, including reasonable legal costs, that we incur as a result of a third-party claim arising from your content, from your use of the Service in breach of these Terms or the Community Guidelines, or from your breach of a law or of someone else's rights.

This does not apply to the extent the loss was caused by our own breach, negligence or wrongful act, and it does not apply to anything you did not cause or contribute to.

17. Complaints and disputes

If you have a problem with FcPal, contact us first at support@fcpal.com and we will try to resolve it with you. For safety concerns and for reviews of moderation decisions, use safety@fcpal.com. For privacy, contact our Privacy Officer at privacy@fcpal.com.

If we cannot resolve it between us, either of us may take the matter further. These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of its courts. If you are a consumer in another country, this does not take away any protection you have under the mandatory laws of that country.

18. Changes to these Terms

We may change these Terms as FcPal changes. If a change is significant we will tell you in the app or by email at least 14 days before it takes effect, unless the change is needed sooner for legal or safety reasons.

Changes do not apply to anything that happened before the change took effect.

If you do not accept a change, delete your account before it takes effect and we will refund any Tokens you purchased and have not spent. If you keep using FcPal after a change takes effect, the new Terms apply to you.

The date at the top shows the current version.

19. General

The whole agreement. These Terms and the Community Guidelines are the whole agreement between you and us about the Service.

Severance. If part of these Terms is found to be unenforceable, the rest continues to apply.

No waiver. If we do not enforce a right straight away, we have not given it up.

Transfer. You may not transfer your rights under these Terms to anyone else. We may transfer ours to a related company or to a buyer of our business, and we will tell you if we do.

Events outside our control. We are not liable for a failure to provide the Service caused by something outside our reasonable control.

Notices. We may give you notice in the app or by email to the address on your account.
